1. Acceptance of Terms

By accessing or using FireProDocs ("the Application"), you ("User") agree to be bound by these Terms of Use and Disclaimer. If you do not agree to these terms, do not use this Application. These terms constitute a legally binding agreement between you and JSAW Fire Consulting Services LLC ("Company," "we," "us," or "our").

2. Nature of the Application — Reference Tool Only

FireProDocs is a documentation assistance tool designed to help fire protection professionals generate reference checklists for inspection, testing, and maintenance (ITM) activities. The Application and all content, checklists, inspection items, and code references it generates are provided for general reference and documentation assistance purposes ONLY.

FireProDocs does NOT:

• Replace, supersede, or constitute compliance with any NFPA standard, local ordinance, state law, federal regulation, or Authority Having Jurisdiction (AHJ) requirement
• Constitute professional engineering, legal, or fire protection consulting advice
• Guarantee regulatory compliance, AHJ approval, or passing of any inspection
• Serve as an official inspection record unless independently verified by a qualified professional
• Replace the professional judgment of a licensed and qualified fire protection inspector

3. User Responsibility

User acknowledges and agrees that:

• All fire protection inspections must be performed by qualified, trained, and appropriately licensed professionals
• User is solely responsible for verifying all checklist items against the current adopted edition of the applicable NFPA standard or code in their jurisdiction
• NFPA standards are adopted at the state and local level and the edition in effect varies by jurisdiction — User must confirm which edition applies in their area
• User assumes full professional and legal responsibility for all inspections performed using or assisted by this Application
• Checklists generated by FireProDocs are starting points for documentation and may not reflect all requirements applicable to a specific system, occupancy, or jurisdiction

4. No Affiliation with NFPA

FireProDocs and JSAW Fire Consulting Services LLC are not affiliated with, endorsed by, sponsored by, certified by, or authorized by the National Fire Protection Association (NFPA). All NFPA standards referenced within this Application are independent publications of the NFPA and remain the sole authoritative source for fire protection requirements. Users should always consult the current official NFPA publications and their local AHJ.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JSAW FIRE CONSULTING SERVICES LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM INSPECTION ERRORS, OMISSIONS, REGULATORY NON-COMPLIANCE, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall the Company's total liability to User exceed the total amount paid by User to the Company in the twelve (12) months preceding the claim.

6. Indemnification

User agrees to indemnify, defend, and hold harmless JSAW Fire Consulting Services LLC and its members, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) User's use of the Application; (b) any inspection performed using the Application; (c) User's violation of these Terms; or (d) User's violation of any applicable law or regulation.

7. Accuracy of Content

While JSAW Fire Consulting Services LLC makes reasonable efforts to ensure checklist content reflects generally accepted fire protection practices, we make no warranty, express or implied, regarding the accuracy, completeness, currentness, or fitness for a particular purpose of any content generated by the Application. NFPA standards are periodically revised and local amendments may apply. User is responsible for ensuring compliance with the current applicable standard.

8. Intellectual Property

The Application, including its code, design, checklist content, and all related materials, is the proprietary property of JSAW Fire Consulting Services LLC and is protected by United States copyright law. Users may not copy, reproduce, distribute, modify, or create derivative works from the Application without express written permission from the Company.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Florida.

10. Changes to Terms

JSAW Fire Consulting Services LLC reserves the right to modify these Terms at any time. Continued use of the Application after any modification constitutes acceptance of the updated Terms.
